Health Warranty/Guarantee for Mary Ann’s Goldendoodles

48 hour warranty: This puppy is in good health to the best of my knowledge by my own observation and using a seasoned veterinarian for exam and vaccinations. Buyer has 48 hours to have their new puppy examined by a licensed veterinarian, excluding Saturday & Sunday. Puppies picked up/delivered on Friday, must see vet by Monday. If the puppy is not taken to a licensed veterinarian within two business days, then the health warranty on the puppy is void. All vaccines must be administered by a licensed veterinarian ONLY otherwise this health warranty is void. The breeder holds the right to have the puppy re-examined by their veterinarian to validate. Any vet expenses incurred by the buyer will not be refunded. Seller guarantees against fatal viruses for 72 hours after purchase. These include, but are not limited to, PARVO, DISTEMPER, CORONA. No guarantee on fatal viruses after 72 hours. We also cannot guarantee that your puppy will never develop any health problems, just like a pediatrician cannot guarantee that a child will never develop any health problems in the future. Some things are just not able to be predicted. Our parents are free of diseases, disorders, and health problems or we would not breed them. That means the puppies are less likely to develop problems.
Worms: Even though at Mary Ann’s Goldendoodles we do our best to rid your puppy of worms, it is possible that the puppy may still have worms. You should have your vet do a routine stool sample check at each visit in order to ensure you have effectively treated long enough to break the continuing cycle. We do not guarantee that your puppy will not have parasites, it is possible for them to have a negative stool sample at our vets, then become infected again due to the stress of moving.
Guarantee: Mary Ann’s Goldendoodles guarantees your Puppy from hip dysplasia, elbow dysplasia, eye conditions that are genetic in origin, von Willabrand's Disease, and genetic heart disorders that are serious enough to require treatment, until 24 months of age. If the puppy is diagnosed by
OFA (or other accredited certifier) as being severely dysplastic on or before 24 months of age, the Buyer must submit a copy of the OFA report to Mary Ann’s Goldendoodles. A veterinarian cannot make the diagnosis, it can only be made by OFA, Penn Hip, or other accredited hip specialist certifiers and the puppy must be sedated for the radiograph to be taken.
Life Threatening Defects: If the Veterinarian determines that the puppy has a life threatening hereditary defect as stated above, a statement setting forth such defect from diagnosing Veterinarian, on the Veterinarian's letterhead, must be forwarded to Mary Ann’s Goldendoodles within 24 hours of such determination. Mary Ann’s Goldendoodles reserves the right to have the puppy examined by a veterinarian of our choice, at our expense, to validate for any life threatening diseases; all other veterinary and transportation expenses are the Buyers obligation. If the puppy is found to have a life threatening hereditary defect as stated above, Mary Ann’s Goldendoodles will reimburse buyer for veterinary expenses related to the defect up to the purchase price of the puppy, with the buyer retaining ownership of the puppy. Shipping fees will not be refunded.
Breeder will not replace or refund for any personal reasons, but not limited to, allergies, mortality, landlord’s disapproval, family disagreement or any other problems not related to health, nor for a puppy’s illness caused by neglect, exposure to weather, injury, choking, poisoning, etc. This warranty does not include viral illnesses, infections, improper bites, hernias, patella luxation, cancer, retained testicles, food allergies, minor heart murmurs (level 1 or 2), thyroid issues, Guardia or Coccidiosis. It also does not include any illness due to the ingestion of foreign objects, food, chemicals, physical injury or issues whose cause is unknown or may have an environmental link. These are not considered life threatening diseases. The breeder does not guarantee against unknown defective genes that does not produce an illness within the guarantee period. This guarantee excludes conditions that arise from obesity or senior ailments, such as blindness, diabetes, etc. Once the puppy is delivered, the buyer assumes all responsibility for the puppy. Breeder does not guarantee against common puppy issues such as but not limited to coccidia, which can be caused by stress, worms, guardia, ear mites or kennel cough. These are common puppy ailments and can easily be treated. Your puppy has been treated on a schedule from the age of 2 weeks for these conditions and it is now the Buyers responsibility to continue on any needed treatments and have the puppy checked for parasites on a regular basis. No guarantee is also given on hypoglycemia (low blood sugar) which is preventable. Also excludes training difficulties or behavior problems.
Note: The breeder cannot guarantee size or temperament. The breeder can only estimate the size based of weight and the size of the parents. Puppies could grow larger or stay smaller than projected size, the same as children. Breeder does not guarantee color, coat quality, amount of shedding, reproductive capability or lifespan of puppy. This puppy is PET quality only.
Public Exposure: Although you may be tempted to rush your pup to the pet store, parks and other public areas to show off your new pup, until they have received all vaccines and rabies, you expose your new baby to unnecessary risks, including having a stranger pet your new pup. Avoid the temptation and show pictures. Doing any of the above before vaccines are completed will void this Health Warranty. As a rule I do not take my dogs out until they are approx. 5 months old.
Reproduction: Any dog that has sired or whelped one or more pups is no longer covered under this guarantee.
Changing Possession: If for any time the Buyer can no longer retain possession of the dog, the Breeder is to be contacted and given the first option to resume full ownership. The dog will be returned with their veterinarian records and all paperwork issued for the dog, including any registration documents. Breeder is always willing to take dog back at no cost to breeder at any time in their life. Breeder does not want any of their dogs in any shelter or rescue. Breeder must approve new home. Breeder must be contacted when Buyer moves with new contact information.
Spay & Neuter Agreement
_____ (1) Buyer agrees to neuter/spay the above described doodle on or before 9 months of age.
______(2) Buyer agrees to be responsible for any and all associated veterinary costs, and to provide Seller with a certificate of alteration signed by a licensed veterinarian within 10 months of the puppy's date of birth.
______ (3) If Buyer fails for any reason to spay/neuter the above doodle on or before the date listed and/or provide the Seller a certificate of alteration, the Buyer agrees to pay for any and all fees, including but not limited to, legal fees, court costs, depositions, telephone bills, veterinary expenses, etc. incurred by the Seller and it's agents to enforce this contract. Such failure will also invalidate the health guarantee provided for the doodle.
______ (4) Transfer of ownership or housing of this doodle does not limit or in any way change the responsibility of the above named Buyer to spay/neuter the animal as per this agreement.
Conditions of guarantee and agreement are as follows:
This guarantee is non-transferable. If the puppy has been sold, or given away, the health guarantee becomes void. All veterinary costs are the owner's expense. If the puppy has been physically injured or abused in any manner, this guarantee is void.
The puppy must be kept current on all vaccinations. Vaccines must be no less than three weeks apart and no more than four weeks apart for a series of three and should not begin until the puppy is at least 10 weeks old. Rabies vaccines cannot be administered before 16 weeks of age and should be delayed as long as allowable by law. The puppy should be kept on a flea and tick preventative as well as a monthly heartworm preventative. DO NOT USE TRIFEXIS! Doing so will void this guarantee. Internal flea preventatives should not be used and will void your guarantee. Monthly heartworm preventative is required or it will void your guarantee. Copies of these records are required to be submitted to Mary Ann’s Goldendoodles if Buyer is requesting reimbursement. This health guarantee is void if the puppy has not been given necessary vaccinations, regular heart worm, or is housed in an outdoor kennel. Dogs must be housed indoors. Buyer agrees to keep records and record of quality food. Failure to abide by these terms will void the Health Guarantee.
If the puppy should die from a suspected congenital defect within 24 months of age an autopsy must be performed, at the Buyers expense, by an accredited institution set up to do such exams, such as a university such as Texas A&M, and the report must accompany the request for a refund. Autopsies done by a local veterinarian are not accepted. The owner of the pup will pay the expenses. Shipping and any vet expenses incurred by the buyer will not be refunded. All
Registration documents (if provided) must be returned. If the autopsy determines that a congenital defect is the cause of death, Mary Ann’s Goldendoodles will provide another puppy of equal value to the Buyer or refund the purchase price of the puppy.
All purchase agreements and spay/neuter contracts must be signed and returned to Mary Ann’s Goldendoodles prior to taking possession of the puppy or health guarantee is void. All certificates of spay/neuter must be provided to Mary Ann’s Goldendoodles by the time the puppy is 9 months of age or the health guarantee is void and legal action may be taken at the Buyers expense.
Signature: This agreement has been entered into by the Breeder (Mary Ann’s Goldendoodles) and the Buyer in the state of Texas and the laws of the State of Texas shall determine all the questions pertaining to the construction and validity of this agreement. The parties involved agree that this contact has been executed in ___________________________, Texas/Oklahoma. Any action brought under this contract may be brought in only within the Judicial Circuit in _______________________ Texas/Oklahoma. If buyer shall default on their obligations under this agreement, which default results in expenditure of attorney fees and/or court cost, to enforce the terms of this agreement or to recover damages for breach of this agreement, or to defend against a lawsuit brought by the Buyer and the Breeder prevails, then the Breeder shall receive payment for all reasonable necessary cost in anticipation, and preparation for litigation; including, but not limited to, attorney fees, and all travel expenses incurred by them and their attorney.
It is mutually understood and agreed that all terms and agreements in this contract shall be extended to and be obligatory upon to any heirs, executors, administrators, successors, and Personal Representatives of the respective parties and/or their assigns.
No warranties or guarantees, expressed or implied, are made under this contract except as stated.
Should any litigation arise regarding the puppy for any reason the purchaser agrees to let seller determine venue.
I, AS THE BUYER, OR HIS/HER REPRESENTATIVE, OF THIS PUPPY, HAVE READ, UNDERSTAND, AND AGREE TO THE ABOVE WARRANTEE/GUARANTEE.
Acceptance of puppy or puppies is acceptance of this agreement.
